    The depositions of Benjamin Belgrave Franklin of Luton in the County of Bedford Surveyors taken and made before us Walter Thomas Lye and Herbert Owen William Esquires two of his Majesties Justices of the Peace for the said County acting in and for the said County and in and for the Petty Sessions Divisions of Luton within which the Parish of Limbury hereinafter on mentioned is situated at the Magistrates Court Luton aforesaid this 22nd day of January 1912 upon the matter of the stopping up and diversion of a certain footpath on public highway situate within the parish of Limbury in the said County leading from Biscot Road Luton in a Northerly direction to the Biscot Mill which the Justices viewed on the 29th day of November last. The said Benjamin Belgrove Franklin upon his Oath saith:- I am Surveyor to the Luton Rural District Council. I produce the plan hereunto annexed marked “A” and signed by me which well describes the present footpath on public highway situated in the Parish of Limbury a part whereof is intended to be stopped up and diverted and the lands through which the proposed footpath on public highway in lieu thereof is intended to be made and also the proposed diversion. I prepared the same plan and the metes bounds and admeasurements marked thereon are correct. I also produce the certified copies marked “B” and ”C” of the minutes of meetings held on the 15th day of September 1911 and the 17th day of November 1911 the Parish Council of Limbury within which Parish the said footpath on public highway is situated consenting to such stopping up and diversion of the said footpath on public highway. I also produce certified copy marked “D” of the minute of a meeting of the Luton Rural District Council held on the 23rd day of October 1911 consenting to such stopping up and diversion. I produce the consent marked “E” of the owner of the lands through which the proposed footpath on public highways is intended to be made consenting to such diversion. I produce a duplicate notice marked “F” signed by me as Surveyors to the said Luton Rural District Council of the intended application to the Court of the Quarter Sessions for an Order for stopping up and diverting a portion of the said footpath. A duplicate of the notice signed by me as aforesaid was affixed on the 30th day of November 1911 by the side of and at the end of the said footpath and at the end of the new footpath on public highway proposed to be made in lieu thereof and the same notice remained there for four successive weeks as from the said 30th day of November 1911 and the same notice was inserted in the “Luton News” being a newspaper circulated with the Parish of Limbury on the 30th day of November 1911 the 7th Day of December 1911 the 14th day of December 1911 and the 21st day of December 1911 copies of which papers are annexed hereto and marked “G” “H” “I” and “J”. On Sundays the 3rd day of December 1911 the 10th day of December 1911 the 17th Day of December 1911 and the 24th day of December 1911 like notices were affixed on the door of the Parish Church of Biscot being also the Parish Church of and for the Parish of Limbury and also on the door of the Parish Church of Luton. The foregoing depositions of Benjamin Belgrove Franklin was taken and sworn before us at Luton aforesaid on the day and year first before written. Signed B. B. Franklin Herbert Owen William W. T.
