    Parties: (i) Thomas Hodges of Biggleswade, gardener, and Robert Hodges of the same, schoolmaster, (trustees and executors named in the will of James Hart, late of Old Warden, blacksmith, deceased). (ii) Cornelius Bennett and Robert Twelvetrees of Biggleswade, bakers and co-partners. Recitals: Admission of James Hart on the Surrender of Thomas Gale to certain customary or copyhold hereditaments holden of the manor including the piece or parcel of ground and hereditaments described below (see (a)) and intended to be bargained and sold, limited and appointed or otherwise assured, 26/27 Apr 1814 (see Z 590/3). Will of James Hart, 24 Oct 1836 (see Z 590/20 -21): recital here states that 3 of the copyhold tenements (see Z 590/21) mentioned therein, 2 (the third cottage was presumably that in Z 590/20) were the cottages or tenements thereinafter more particularly described and intended to be assured by this bargain and sale. Death of James Hart, 9 Nov 1836, probate of his will 3 Dec 1836, and death of his wife Kitty Hart, 26 Nov 1856 (see Z 590/20-21). That (i) then caused the said freehold and copyhold hereditaments (see Z 590/21) to be put up to sale by auction in 4 lots at which sale (ii) were declared highest bidders for and the purchasers of the copyhold hereditaments comprised in Lot 3 in the particulars of the sale and intended to be hereby assured, for £90. Operative Part: Bargain and sale (grant, bargain, sell, limit, appoint, convey and assure) from (i), in consideration of £90 paid to (i) by (ii) and in pursuance and exercise of the power and authority given to them by the will of James Hart (see recitals), deceased, and for effectuating the recited sale, to (ii) of: (a) piece or parcel of ground situate in Biggleswade near Crab Lane with the two cottages standing thereon now or late in the tenure or occupation of William Newman and Richard Bird; containing 40’ in length, 32’ in breadth at the S. end and 20’6” at the N. end; and bounded on the E. by the fence formerly of Thomas Gale, on the W. by the fence of Benjamin Woods, on the S. by Rudds Bank and on the N. by the Anchor Public House. Together with right of footway leading thereto and all appurtenances. Habendum: to (ii), their heirs and assigns as joint tenants in trust for themselves, their heirs and assigns as tenants in common but nevertheless according to the custom of the manor of Biggleswade and subject to the rents, fines, suits and services therefore due and of right accustomed. Nomination and Appointment, absolutely and irrevocably, by (i), as trustees of the power to them in that behalf given by the will of James Hart, of (ii), their heirs and assigns, unto the tenancy and ownership of (a) to be held as above. Admission of (ii), (Cornelius Bennett and Robert Twelvetrees by Cornelius Bennett his attorney), tenant(s) of the premises so conveyed (see recital) to their use. Habendum: to (ii), their heirs and assigns for ever according to the tenor and effect of the recited Indenture of Bargain and Sale, of the Lord of the Manor etc. Rent: 1d Fine for estate and entry: not stated.
