    Parties (i) William Garner of Road Farm Cottage, Biggleswade, market gardener, and Nathaniel Garner of Langford, labourer [Trustees]. (ii) Ellis Piggott Jeakings of Market Place, Biggleswade, bootmaker. [Purchaser]. a) Nathaniel Garner admitted tenant 28 Apr 1876 (see Z 590/35) to the hereditaments in the first schedule and on 4 May 1832 was admitted tenant to hereditaments comprised in the second schedule (see Z 590/8), and on 1 May 1857 was admitted to hereditaments comprised in the third schedule (see Z 590/22), and on 24 February 1879 (see Z 590/39) Nathaniel Garner surrendered out of court the three schedules, together with: All buildings, rights, fixtures etc. belonging or appertaining to the use of James Scrogie his heirs and assigns to secure the repayment of £150 and interest. b) By an Indenture dated 11 October 1882 (see Z 590/40) where James Scrogie assigned to Fanny Cook the principal sum of £120 leased and released the said property subject to the equity of redemption then subsisting therein. c) By an Indenture dated 6 December 1890 made between Fanny Cook (of the first part), the trustees (of the second part), and Helen Scrogie (of the third part). Fanny Cook assigned to Helen Scrogie £100 (thereby declared to be the balance then remaining due upon the conditional surrender.) d) Nathaniel Garner duly made and executed his last will and testament 16th Nov 1882 and directed the trustees to sell and dispose of the copyhold hereditaments to which he was seised and for effecting such sale empowered them to execute all such assurances as might be necessary. Nathaniel Garner died at Biggleswade on the 24th January 1887 without having altered his will. The will was never proved because the testator had no personal estate. e) Ann Garner, widow of Nathaniel Garner (to whom a lifetime interest was given in the proceeds of sale and conversion of the Testators estate) died at Luton 22nd September 1892 and was buried at Biggleswade. (i) bargain, sell, appoint, convey and assure to (ii) all the land in the three schedules subject to the conditional surrender. Signed with a receipt for £30 received by (i) from (ii).
