Recitals
Statement that this indenture is supplemental to Z 590/38 -39; the record of Z 590/39 describing the parcels as ‘4 cottages, onion lofts, barns and outbuildings, hereditaments and premises copyhold of the manor of Biggleswade...one of the cottages has since been destroyed by fire’.
That there is now due to (i) on the security aforesaid £120. £30 having been paid off.
That (ii) has agreed to pay (i) £120 upon having transfer of the principal sum and interest accruing and to accrue due and the securities for the same.
Operative part
Assignment by (i), as mortgagee, in consideration of £120 paid to him by (ii), to (ii) of the principal sum of £120 owing on the aforesaid securities and all interest to become due thereon and the full benefit of and right to exercise and enforce all powers, covenants and securities for compelling payment of the sum and interest.
Habendum to (ii) absolutely.
Conveyance, assignment and release from (i) to (ii), her heirs and assigns, of all the copyhold or customary tenements and hereditaments covenanted to be surrendered by Z 590/38 with their rights, easements and appurtenances.
Habendum: to (ii) her heirs and assigns according to the custom of the manor for all the estate, right and interest of (i) therein and thereto subject to such right of redemption as is now subsisting therein by virtue of Z 590/38.
