so iii) may become tenants to the precipe for common recovery to be suffered, to enure to uses as i) shall declare

reciting above Indenture and fine and recoveries duly levied; agree that they shall enure:
to use of John for life, then to trustees for 99 years for raising £1,000 per annum to Bridget for life and subject thereto, to use of said William in tail male with power of revocation to i)

certifies that besides estate of late John Lord Ashburnham in aforesaid premises in Sussex and Bedfordshire also in pursuance of RO1/18 afterwards had other premises in Bedfordshire worth £500 per annum and other premises in reversion after death of Ursula Taylor worth £400 per annum, premises comprised in Indentures of 12 May 1702 are worth £3,000 per annum
By Indenture of 22 January 1708/9 and fine levied accordingly John late Lord Ashburnham and wife Bridget settled premises in Wales worth £12,000 per annum on said John, remainder to Bridget, remainder to first and subsequent sons.
Recites: will of John late Lord Ashburnham, who is since dead, leaving male issue only William and Bertram; William and his wife Katherine are both dead without issue.
John now Lord Ashburnham believes that he is entitled to specific performance of marriage settlement of William (RO1/18) and that trustees named in John’s will and all others having any estate in said premises ought to join in settling so many of the premises in Sussex, Bedfordshire and Wales as amount to £5,000 per annum.
Bertram consents to this if the court so orders
