- Scope and Contenti) Thomas Spence Daniel Mardell John Hudson ii) Thomas Lindsell recites: SL1/126 and 127 whereas: Edward Ellis had contracted for sale of entirety of premises mentioned in above deed but good title could not be produced to2 1/3 parts, the same being then vested in John Harvey of Ickwell Bury, esquire, then aged 7 as tenant in tail male, but notwithstanding Edward Ellis paid full price for land upon receiving bond next recited as security : SL 1/128 : SL 1/133 : Edward Ellis died without having revoked or altered said will and codicils. Will proved (PCC) 8 January 1833 : i) caused lands and premises built on them by Edward Ellis to be put up for sale and ii) declared highest purchaser for £660 : SL 1/136 and 137 now i) have assigned to ii) bond of 22 February 1823 [SL 1/128] and to enable ii) to receive monies etc. due under said bond i) have appointed ii) as their attorney to receive from Thomas Kington Bayly, Sarah and Mary Harvey all sums of money which may be due provided always that John Harvey will convey 2 1/3 parts and confirm the title of ii). If John shall not make such conveyance, the monies recoverable under said bond shall be considered as personal estate signature i) endorsed witness Edward Robert Spence
