    (i) Henry Wolsey Bayfield, now of City of Quebec, Province of Lower Canada, Captain in Royal Navy. (ii) John Orlebar of Podington Bedfordshire now at Quebec, Lieutenant in Royal Navy and Elizabeth Harriot Hale his wife (iii) Richard Longuet Orlebar of Hinwick House, Bedfordshire (iv) Edward Hale of Portneuf in aforesaid province. recites: Marriage Settlement. 5 February 1838 prepared and executed at City of Quebec in province of Lower Canada. (i) said John Orlebar (ii) Elizabeth Harriot Hale spinster daughter of Honourable John Hale (iii) Honourable John Hale of City of Quebec, Receiver General and one of the members of the legislative council of the said province (iv) Edward Hale of Portneuf in said province, Henry Wolsey Bayfield, a Captain in Royal Navy. in the marriage treaty it was agreed that John Orlebar should assign on trust £1,350 with interest then in the hands of his eldest brother Richard Longuet Orlebar, secured on the Great Tithes of the parish of Walthamstow, Essex and a certain share, belonging to John Orlebar in a sum of money amounting to £1,200 secured on funded property of his aunt Mrs. William Augustus Orlebar at her death; and all John Orlebar’s personal estate to the extent of the sum of money which Elizabeth Harriot Hale might receive from the estate of Honourable John Hale; the sum which Elizabeth Harriot Hale might receive from Honourable John Hale and the personal estate which she then possessed to be settled on trusts . . . . now: Elizabeth Harriot Hale appoints Honourable John Hale as trustee in place of John Orlebar who is unwilling to act in the trusts.
