  • Scope and Content
Whereas in Trinity term, 1664, Sir Lodovic Dyer, baronet, exhibited his bill of complaint against William Gery esquire, Sir Thomas Gery, knight, Richard Newdigate, sergeant-at-law, Robert Leigh and George Parker: it was then decreed that the Gerys should come to an account for the profits they had received out of the land in trust mentioned in the order; and for the debts in the schedule annexed to the deed of trust. The Master reported that there was a debt of £100 due to Thomas Holt, which Sir Lodovic Dyer, having been bound thereto by William Gery, had paid; and £100 to Rogers (for which Dyer and Gery were bound), Dyer having paid £150; and £200 to one Acton (all paid by Dyer); a new order was made, but Sir Lodovic then died; William Dyer as his father's administrator was granted a new hearing, and it was ordered that the trustees were to sell lands and pay debts to William Dyer plus damages; the defendants did not appear at two hearings; it was therefore ordered that the lands should be sold, debt and interest paid to Dyer, and that other creditors should put in claims; 7 July 1673 the Master's order was confirmed by decree; no creditors have come in except executors of Walter Stafford, who claim £50; it is now reported that defendants have not sold lands; order is now made absolute.
