    Plaintiffs: James Ward, Joseph Spencer, William Wright the elder, Samuel James Wheeler, George Sturges the younger. Defendants: William Hipwell, William Lawton Wykes, William Dickins. Corrects statement made in the bill of complaint as to the date of the formation of the congregation. Quotes indentures setting out the running of the congregation. Gives their understanding of the intention of the use of the house erected on the land purchased from William Hipwell. Deny that the house erected was furnished by the trustees of the chapel out of money raised by voluntary subscription. Claim that the house was first occupied by Samuel Norton and then by Shadrach Bicheno who both paid rent for it. Mr Williams resided in the house from February 1847 - 6 July 1859. House then occupied by George Bayes and his wife as caretakers and Mr Evans lodged there with them for a month from 27 Oct 1859 to 21 Nov 1859. Reason why they do not believe Samuel James Wheeler to have been properly elected pastor. Circumstances of the letting of the house to Mr Islip. Agree that person put into the house on the night of 31 Oct 1860 was forcibly ejected but claim that William Hipwell was only with seven or eight men. Deny that the property has been mortgaged. Miss Islip took possession in August 1860 and removed there for a permanence on 28 Jan 1861 and for some months previously a man and his wife had lived in the house to keep it in order at Mr Islip's expense. Deny that the congregation are unanimous in wishing Mr Wheeler to occupy the house. William Dickins denies being privy to a letter being sent and James Mote should not have used the name of William Wright the elder as defendants are informed and believe that the said William Wright was at the date of the said letter and for a least three years previously thereto and has ever since been and is now of unsound mind and incapable of managing himself or his affairs.
