    Plaintiffs: James Ward, Joseph Spencer, William Wright the elder, Samuel James Wheeler, George Sturges the younger. Defendants: William Hipwell, William Lawton Wykes, William Dickins. Gives details of the founding of the congregation in 1786, the decision to purchase land and build a manse in 1843, occupation of the manse by minister Mr Williams and then by probationary minister Mr Evans in 1859, meeting of church on 4 July 1860 that elected Samuel James Wheeler as pastor of the church, applications in Sept 1860 by the plaintiffs to the defendants for possession of the manse to be given up to Mr Wheeler, decision of a meeting on 27th July that the manse should be let to Mr W Islip for his sister's residence at £20 per year. Forcible possession was taken by the plaintiffs on 31 October 1860 but the person put in the house was ejected the same night by thirteen men headed by the defendant William Hipwell. The Plaintiffs consulted Mr Mote, solicitor. The defendants attempted to justify their conduct on the ground of the necessity of paying off the debt and alleged that Samuel James Wheeler had not been properly elected according to the rules laid down by the Church Trust Deed. William Dickins position in the matter. Offer made to the defendants but no response being received bill filed against them.
