  • Scope and Content
Details given: Plaintiffs claim that Elizabeth at her death was seised in fee simple of a messuage and farm in Sharnbrook of value £70 per annum and also possessed of personal estate of £200, and owed debts to the amount of £200, particularly £150 to Joseph. That by her will of 19 October 1715 she gave to Rebecca all her personal estate discharged of all debts and legacies (including said debt to Joseph and legacy of £100 to Rebecca and of £10 to Ann Harding, cousin of Elizabeth); also half the remnant of her real estate after all debts legacies and charges (including those named) had been raised therefrom; also the remaining half after the death of Anne Aspin. Defendants dispute the values given by plaintiffs of testatrix' real and personal estates and debts and claim that all debts, legacies and charges should be raised from the personal estate and from the real estate only in aid; and that the remnant of the real estate should be divided between Rebecca and Anne Aspin, and Rebecca's Share should descend to Anne. Order: The estate is to be disposed of in accordance with the plaintiffs' claim; A Master in Chancery (Mr Orlebar) is to take account of the relevant monies; and a Commission is to divide the remnant of the real estate after all charges have been met.
