- Scope and ContentDetails given: Plaintiff: recites WG 2726; Henry Blows erected Tempsford mill on site; mill vested in Charles Powers (died 1873), defendants his residuary legatees; lessees responsible for repairing breaches in banks and dams - 2 breaches occurred in December 1882, when defendants refused to repair them. Plaintiff claims: (a) Injuction to defendants not to maintain excessive head of water at mill (b) Defendants to be ordered to repair breaches and to pay damages. Defendants: subsequent to erection of mill, Ivel Commissioners constructed new cut from Blunham common to Tempsford mill; Ivel Navigation Abandonment Act,1876, lands sold to be kept in repair by purchasers – land sold to plaintiff; breaches occurred in new cut, not in property covered by lease.
