(iii) Herbert Astley Paston Cooper of Aylesbury, Buckinghamshire, said William Henry Horne, Edward Mash Browell of Feltham, Middlesex (iv) Midland Railway Company. whereas: William Henry Horne and Reverend Frederick Edward Horne are each entitled to a moiety of land hereby conveyed; a moiety of each moiety is subject to :- Mortgage of 27 May 1871 (i) William Henry Horne and Reverend Frederick Edward Horne (ii) John Vickerman Longbourne (iii) Herbert Astley Paston Cooper of Aylesbury, Buckinghamshire, said William Henry Horne, Edward Mash Browell of Feltham, Middlesex, Algernon Smith Dorrien, since deceased of such a sum of money as within 3 months of the death of Reverend Frederick Edward Horne, should, together with the proceeds of his life insurance, make up £5,000. whereas: Midland Railway Company is empowered by (New Works) Act 1876 to purchase the herein conveyed hereditaments for the Rushton and Bedford Widening Deviation for £300. Herbert Astley Paston Cooper, said William Henry Horne, Edward Mash Browell, are satisfied that the other hereditaments subject to the mortgage are sufficient security. NOW: consideration: £150 each to William Henry Horne and Reverend Frederick Edward Horne -- pieces of land situate in Felmersham, 1 acre 2 roods 34 perches (see map in deed) in accordance with the Railway Clauses Consolidation Act 1845 (a) a culvert not less than 128 long to be constructed over backwater, to have proper approaches and a gate on each side. (b) continuation of an underbridge already existing (c) continuation of way already running under existing viaduct, so as to have approaches at least 12 yards long on either side and way under viaduct together with approaches to be properly metalled. also convey right of way over lines; Company may discontinue this level crossing.
