    Recites Letters Patent of Charles I, 20 June 1632, to Cecilius, Baron of Baltimore, great grandfather of Charles, giving bounds of Maryland and the land therein contained. Also Letters Patent to William Penn, grant of Pennsylvania. Also Conveyance, 24 August 1682: James, Duke of York to William Penn, -- town of Newcastle and a 12 mile tract around it. Also conveyance of even date, Duke of York to Penn, -- tract of land on Delaware river. Disputes have arisen as to boundary between Pennsylvania and Maryland “in regard that the observations made by mathmeticians and other skilful persons from time to time in order to the fixing the place of the 40° of northerly latitude . . . . . greatly varied and differed from each other”; and as to the fact that the counties of Newcastle, Kent and Sussex, assigned to Penn, were included in Maryland’s charter. “For putting a final and friendly end and accommodation to the said disputes . . . . “ it is agreed:- to mark out the circle 12 miles distant from Newcastle; to draw an east and west line across the peninsula (containing Newcastle, Kent and Sussex) beginning at Cape Hinlopen south of Cape Cornelius from the coast to the exact middle of the peninsula; to draw from the western end of this line another north up the peninsula till it touches the western edge of the circle, and from thence to run due north till it reaches a point 15 miles south of the latitude of Philadelphia; an east and west line should run from this point west across the Susquehannah river to the western extent of Pennsylvania; to appoint commissioners to lay out the actual boundary, to be marked with posts, stones, etc., with arms of Lord Baltimore on one side and of Pennsylvania on the other.
