    Reciting HE 217. and that Mrs. Fowler died 1851. Ann. Hanscombe widow, is also deceased and also one of the grandchildren of Elizabeth Wand. Several assignments of shares of the real and personal estate have been made by John Atkinson, Ann Marshall and several of the grandchildren of Elizabeth Wand. deceased. Q. Whether any and which of the devisees in remainder of the real estate took a vested interest transmissable to their respective heirs. Whether any or which of the residing legatees in remainder took a vested interest. Whether if all devisees and residing legatess in remainder now living and the assignees were to offer to join in releasing Mr. Trustman's executors, the latter could safely divide the trust funds without any direction of the court upon a bill filed. A. Ann Hanscombe widow, William Hanscombe, Mary and Ann Hanscombe the daughter, John Atkinson and Ann Marshall took vested ints. transm. to heirs in both real and residing personal estates, but the amount transmissable depended on the no. of surviving children and grandchildren of Elizabeth Wand. The interests of the children and grandchildren of Elizabeth Wand were contingent and only those surviving Mrs. Fowler take anything. The property both real and personal is now divisible between these parties. The trustees must ascertain whether the assignees have the power to give effectual releases otherwise the parties may release the executors, who may safely divide the funds.
