- Scope and ContentParties: (i) William Kinder of St.Albans [Hertfordshire], esquire; (ii) Thomas Kinder of St.Albans [Hertfordshire], common brewer [eldest son and heir at law of Thomas Kinder, late of St.Albans, common brewer, deceased, who had died intestate] Reciting: - Thomas Kinder, deceased and (i) had carried on the business of common brewers in St.Albans in partnership for many years and had bought (a)-(w) together; to save expense with copyhold premises Thomas Kinder, deceased was admitted tenant to some and William Kinder to others, with Thomas Kinder, deceased being admitted tenant to (a) Rose & Crown, Leverstock Green, Abbotts Langley [Hertfordshire] held of Manor of Abbotts Langley alias Lees Langley and to (b) White Horse, Wheathamstead [Hertfordshire] held of Manor of Wheathamstead with Harpenden purchased from John Dickson, victualler; William Kinder being admitted to (c) Bell & Shears, now called Red Lion, Redbourn [Hertfordshire] held of Manor of Redbourn purchased from Elizabeth Kingsland, widow and Samuel Kentish and Ann, his wife and remaining third part of property of William Hamill, an infant, was to be surrendered by him to William Kinder when the infant had attained 21 and on payment of 98/19/8; - Thomas Kinder deceased and William Kinder received profits from purchased properties in equal half shares until 11 Aug 1802 when William Kinder wished to retire from the business and it was agreed that Thomas Kinder, deceased would carry on the business alone, paying half the value of (a)-(w) as valued by a valuer, to William; - William Sedgwick of Rickmansworth [Hertfordshire], land valuer for Thomas Kinder, deceased and Robert Hill of Luton, builder for William Kinder had, in May 1803 valued the (a)-(w) at 7,187/10/-, making William Kinder's share 3,593/15/-; - Thomas Kinder's share in (a)-(w) had descended to (ii) as his eldest son and heir at law; - upon inspection (d)-(j) had been purchased by Thomas, deceased and William as joint tenants instead of tenants in common but (i) and (ii) had agreed that on payment (i) would convey all (a)-(w) to (ii) regardless of tenancy; - (i) had surrendered out of court to (ii) on 13 Oct 1803 with (ii) needing to pay William Hammill when he attained 21 58/19/8, 40 having been advanced to him Operative Part: - (i) conveyed (a)-(w) to (ii) for 3,593/15/- Property: (d) two messuages in Fishpool Street, St.Albans formerly in occupation of Richard Wright and Edmund Marston, then Edward How and James White, late Moses Edmonds and Mary Smothwaite, then William Fensham the younger; (e) Hoopers Orchard of 3 roods near (d) formerly in occupation of James Arrowsmith, then Moses Edmonds, now William Fensham the younger; (f) Lower Hoopers Orchard near (d) of 1.5 acres in occupation of Joshua Dearmer, late Moses Edmonds, now William fensham the younger; (g) messuage in Fishpool Street, St.Albans between (d) and (e)-(f) formerly in occupation of Thomas Agglinton, bricklayer, then John Whittington; ((d)-(g) conveyed to Thomas and William Kinder as joint tenants by John Masterman of White Hart Court, Gracechurch Street, London, goldsmith and James Masterman of Cannon Street, London, hatter and dealer in teas, eldest son and heir at law of John Masterman and Maria, his wife (formerly Maria Archer, spinster) on 13-14 Feb 1777 and 14-15 Feb 1781; (h) inn formerly called Talbot, now Dog Inn, French Row, St.Albans, formerly in occupation of George Banfield, then John Nicholls, then Roger Wykes; (i) woodhouse in yard of (h) ((h)-(i) formerly estate of Moat Lankester, deceased, conveyed to Thomas Kinder, deceased and William Kinder as joint tenants by John Masterman and James Masterman, his son, on 3-4 Mar 1778 and 14-15 Feb 1781);
