  • Title
Letter from Ministry of Agriculture & Fisheries to Arthur Thorn: "Extinguishment of Manorial Incidents. Manor of Eyton alias Eaton Bray - Beds I am directed to refer to the Ministry's letter of the 10th August regarding the application to the Minister dated 31st July 1936 to determine the compensation for the extinguishment of the manorial incidents in respect of the lands specified therein, and to say that as no reply has been received within the period specified, it is assumed that you do not propose to approach the lord with a view to arriving at a non-statutory agreement as to the amount of the compensation. In these circumstances, the Ministry must proceed with its Award in the matter and for this purpose, the "annual value" of the property is required for determining the compensation payable for forfeitures (see paragraph 13 of the appendix to memorandum B.27/L.E. enclosed). It is assumed that the property is not separately assessed for the purpose of the Income Tax Acts (see the penultimate paragraph of the Ministry's letter of the 10th August). I am accordingly to suggest that in order to save the expense of employing a valuer to make a valuation which will normally be payable by or recoverable ultimately from you as the tenant, the value might be agreed between you and the lord, and the Ministry informed accordingly. Failing such agreement, it will be necessary for a valuer to be appointed, and I am to suggest that you and the lord might agree as to whom the Ministry should appoint. If within 14 days of the date of this letter, the Ministry is not informed that the parties are able to agree (a) the value, or (b) a valuer, the Ministry will proceed to appoint a valuer of its own selection".
