- TitleLetter from Ministry of Agriculture & Fisheries to J.H.Hoare: "Extinguishment of Manorial Incidents manor of Eaton Bray I am directed to refer to your letter of the 7th May and to say that Rule 6(1) of the Manorial Incidents (Extinguishment) (Amendment) Rules 1935 provides that an application to the Minister to determine the amount of compensation in an extinguishment to which Section 140 of the Law of Property Act 1922 applies "shall be made in the form set forth in the schedule to these Rules or to the like effect". Three copies of the requisite form (No.B.19/L.E.) are accordingly enclosed [see BH/2/79/2/8] for your use, in connection with which your attention is specially drawn to the certificate to be furnished on page (4) of the form. The Minister has made Rules amending the Manorial Incidents (Extinguishment) Rules 1925, prescribing the procedure to be adopted in connection with Section 140 cases. Copies of these amending Rules, i.e. "The Manorial Incidents (Extinguishment) Rules 1925" (Statutory Rules and Orders, 1925, No.810), may be obtained either directly from His Majesty's Stationery Office, Adastral House, Kingsway, W.C.2, or through any Bookseller, price 2d. net and 7d. net respectively. A Rule has also been made fixing the fees to be charged by the Ministry in respect of transactions under the Property Acts, 1922 and 1924. Copies of this Rule, i.e. "The Fees (Compensation Rules and Orders, 1936, No.202) may be obtained from His Majesty's Stationery Office, as above, price 1d. net. An extract from the Rule giving particulars of the Ministry's fees for the more ordinary transactions is enclosed. I am to add that in the Ministry's opinion, the rights preserved by the Twelfth Schedule to the Law of Property Act 1922 are not manorial incidents, and cannot be dealt with otherwise than by a Conveyance. If, therefore, an Award were eventually issued in respect of Mr.Thorn's property, the amount determined to be the compensation would take no account of the preserved rights".
