(b) close of pasture etc as in BORDV13/14(b). 29 Sep 1815. Dorse: memorandum of signing and delivery witnessed by Leonard Hampson; receipt (4 Aug 1823) signed by Thomas Smith (executor of mortgagor TS, deceased) and DR acknowledging receipt of all principal and interest from William Gresham, only son and heir of mortgagor WG (now deceased), and undertaking and agreeing to execute any assignment required thereof; and following indenture of Assignment. Surrender or Assignment from DR, now of Luton, gent., and Thomas Smith of Crawley Green in the parish of Luton, gent (surviving executor named in the will of mortgagor TS, now deceased) to William Gresham of Barnards Inn, London, gent., of (a)-(b) as above to the intent that the residue of the mortgage term be merged and extinguished and attendant upon the reversion, freehold and inheritance for the benefit of WG in fee simple. Consideration: £600 paid to RD by WG (see recitals below). 1823 21 Sep 1823. Signed, sealed and delivered by assignors in presence of Edward Williamson of Luton, solicitor, and Richard Waring, clerk to Mr Williamson, and by assignee in presence of Joseph Arden of Cliffords Inn, solicitor. The deed recites that the mortgagor TS died in May 1820 and his will was proved at P.C.C. by TS (assignor) on 30 Sep 1820; that the mortgage principal was a fund which belonged to TS and DR (mortgagees) as joint tenants and the whole sum secured became payable, therefore, to DR as TS (assignor and executor) admits; and that WG (mortgagor) died 17 Jan 1823 leaving WG (assignee) his only son and heir at law.
