Army), appointor, (acting in pursuance or execution of a power or authority limited and reserved to him by a Release of 2 May 1809 and subsequent Recoveries: see recitals below) to William Gresham of Dunstable, gent., (trustee p.p. William Frederick Brown of Dunstable, gent.) of: (a) Manor of Dame Sayers etc as in BORDV13/8(a), (and BORDV13/10(a).). (b) capital messuage etc as in BORDV13/8(b), (and BORDV13/10(b)) described as formerly of Thomas Cooke, since of George Maddison (as in BORDV13/10), deceased, and now or late of James Field. (c) close of pasture or inclosed meadow ground (formerly 2 closes, containing 4 acs., adjoining to (b) and called 'the Priory', also formerly of TC etc., (as in BORDV13/8(c) and ?BORDV13/10(b)). (d) close or piece of pasture ground, formerly arable land, with appurtenances formerly called Dovehouse Close or Clarks Close and now called Star Close, containing 5 acs., lying on the E. side of Dunstable and near to the town there (land belonging to the Free School of Houghton Regis being on or towards the E. part, the close as in (c) on or towards the N., the lane called Englands Lane on or towards the S. part thereof), formerly in the tenure or occupation of Thomas Edgar or his assigns, since of George Maddison (as in BORDV13/10), deceased, and now or late of James Field; and purchased by GM of John Miller. Habendum: to WG and his heirs to the use of such person(s) for such estate(s) or interests, upon such trust(s) etc as WFB shall direct, limit or appoint and, in default of such direction, to WFB and his assigns for life, remainder to WG during the life of WFB in trust for WFB and his assigns, remainder to WFB in fee simple. Indemnity clause as in BORDV13/8. Consideration: £1,850 (paid to GM by WFB) 3-4 July 1809 (Release consists of 4 membranes) Dorse: sealing and delivery by GM in the presence of J. Haig, paymaster 77th Regt., and J Pacey of Inner Temple; by JTM before Mary Knight (?of Fulford) and Henry Brearey of York, attorney; by HA before (?J) Dallinger of Hertford, solicitor, and R. Kember of Hertford; and by WFB in presence of John Griffiths of Luton and Edward C. Williamson, clerk to Messrs. Hampson and Griffiths of Luton. Recitals include the following: BORDV13/10-11; that GM the father died on 31 Jan 1806; that, at the time of making his will, he was seised of (a)-(d), (the latter being part of the real estate devised in his will to his son George Maddison and the heirs of his body with remainders over), which his son GM (party hereto), shortly after the death of his father, entered and is now in possession and receipt of the rents and profits of the same to and for his own use; Indentures of Lease and Release (to make a tenant to the precipe) of 1-2 May 1809 v. BORDV13/12a-b between GM the son and his wife Mary of the first part, Mordaunt Lawson Clennell of Staple Inn, London, gent, (as in BORDV13/12) of the second part and HA of the third part and two Common Recoveries (including BORDV13/12) suffered by GM/MM in Easter Term last (1809) whereby (a)-(d), inter alia, were conveyed, limited and assured to the use of such person(s) and for such estate(s) as GM should appoint and for want of such appointment to GM and his trustee HA and the heirs and assigns of GM for ever; that GM contracted with WFB for sale to him of (a)-(d) for £1,800; and that John Thomas Maddison of Fulford (York), Lieutenant Colonel in H.M. Army, eldest son and heir of GM as in BORDV13/10-11, second party to the deed, has agreed with his brother GM (the son) to confirm the devise made to GM by their father's will and for the better conveyance andassurance of the premises to be sold to or in trust for WFB, discharged of all estate, right and interest of JTM to the same.
