Parties: (i) William Bartholomew Best of White Hall, Lincoln, gentleman; John Thomas Green of Woburn, gentleman; (ii) John Green of Woburn, gentleman; Samuel Swaffield of Ampthill, gentleman; (iii) William Frederick Green of Woburn, gentleman Reciting: - HN10/277/Brooks38; - will of John Thomas Brooks of 8 Dec 1858 devising all real estate to (ii) as trustees and executors; - death of John Thomas Green and proof of his will in PPR on 15 Mar 1859; - principal still outstanding but all interest paid; - (ii) decided to take a transfer of the mortgage and pay it out of the personal estate of John Thomas Brooks on account of themselves, the mortgage to be kept on foot and transferred to a trustee for that purpose Operative Part: - (ii) paid 1,000 to (i); - (i), by direction of (ii) released (a) in HN10/277/Brooks 38 to (iii); - (i) assigned principal sum of 1,000 to (iii); - (i) appointed (iii) as their attorney Habendum: - to (iii) in trust for (ii) under the will of John Thomas Brooks
