Scope and Content
(i) William Farnell, Arnpthill, baker
(ii) William Claridge, Ampthill, grocer
On 18 May 1832 certain freehold and copyhold estates in Woburn Street, Ampthill, the property of George Costelow were put up for sale in 2 lots. At this sale Charles Farnell, Whetstone, Finchley, Middx, plumber and glazier, was purchaser of Lot 1 comprising freehold messuages in the occupation of William Farnell, William Timms, James Benbow, John Money, William Waldrick and Eliza Juggins. By lease and release of 10 and 11 August 1832, and comprised in schedule, the property by direction of Charles Farnell, has been conveyed to uses for the benefit of (i). (ii) was purchaser of Lot 2 comprising a copyhold messuaae late in occupation of Robert Furze and another in the occupation of William Chater
By 5th condition of said sale it was stipulated that purchaser of Lot 1 should grant to purchaser of Lot 2 a right of foot and barrow way over ground belonging to Lot 1 , of a width of 3 ft 8 inches from tenement in occupation of William Chater, and extending from the street to a barn lately occupied by William Chater and then over full breadth of ground between said barn and Lot 2 to South end of Lot 1, for the use of the owners of the tenement in common with Lot 1.
Passage way is not 3ft 8 inches in all parts
Now in consideration of 10s paid by (ii) to (i)
(i) grants, appoints etc to (ii) and assigns
- free and uninterrupted liberty of ingress, egress and regress for (ii) or with any other person or servants, on foot or with wheelbarrows etc over - pieceground at Woburn Street in Ampthill next adjoining on west of property of (ii) in a direct to boundary wall on S of width of 3ft 8 inches except where contracted or widened by any projection (as shown on map on deed)
- piece of wall of breadth of 3ft 8 inches at, end of S end of said piece of ground between barns and outbuildings shown on said plan being part of said boundary wall
With liberty to take down and remove same doing; no injury to the remaining part and replacing part removed by door or fence.
(i) gives covenants for peaceful enjoyment of such way to (ii) also (ii) agrees to bear the cost borne by (i) in keeping the said road or way in good repair
(i) covenants to produce deeds etc as in schedule
