Taken on oath 5th March 1921 in the presence & hearing of Ernest Bailey, Arthur Cecil Gilbert Roe & Horace Smart charged that they on 14th January 1921 feloniously did steal & take away 2 bicycles value £13.00 the property of Daviv Howell Jenkins
David Howell Jenkins on his oath saith ;-
I am the Pastor at the Wellington Street Baptist Church & I reside at 36 Rothesay Road Luton. The back entrance to my house leads from Adelaide Street, I have a shed at the botton of my garden which I use for storing cycles & other thing. The shed is opposite the right of way&the door of the shed is usually locked at night. The back gateisalso locked at night. About 6pm on Friday14th January 1921 the gents & the ladies cycles now produced to me were in the shed. The following morning Saturday 15th January 1921 about noon I found the 2 cycles were missing. Thinking that my boy had probably taken the cycles out I did not then enquire about them. Later, the same day in consequence of what my boy said to me I reported the loss of the cycles to the police. On uesday 22nd February 1921 I was called to a house in Grove Road by Detective Sergeant Bacon I was then shewn the 2 bicycles produced. In consequence of certain alterations having been made to the bicycles I was unable to identify them.
On Wednesday 23rd February 1921 I found the receipt now produced to me Marked "A" giving the number of the Ladies Cycle. This is the receipt which I obtained when I purchased the ladies cycle. I handed the receipt to the police, On Monday 25th February 1921 I was called to the Police Station where I was shewn the 2 cycles produced. Upon further examining them I identified them as my property & I value them together at £13.00
The gents cycle had been freshly blacked over celluliod mudguards removed & steel mudguards fixed, also fresh handle bars & bell, the ladies cycle has also been freshley blacked over, a different saddle fixed, a gear caseput on & a new dress card fixed. These alterations have all been done since the cycles were stolen.

Arthur Bacon on his oath saith :-
I am Detective Sergeant Bacon in the Luton Borough Police Force. On Saturday 15th January 1921 I received a report of this robbery & made enquires. I examined the shed from where the cycles had been stolen & found that the door had been forced. I made further enquires in consequence of which I visited 40 Grove Road Luton in company with Detective Officer Frost & the witness Jenkins on 22nd February 1921. We there saw the 2 cycles produced & the prisoner, Ernest Bailey. I said to Bailey "What account do you give of these 2 cycles" He said; "I bought them off Park Square 18 months ago" Mr Jenkins was then unable to identify the cycles, butnot being satisfied that they werenot to be removed. On 24th February 1921 I received the reciept now produced, Marked"A"to me from the witness Mr Jenkin. As this receiptgives the number of the cycleI again visited the prisoner Bailey at his home, Upon making a further closeexamination of the ladiescycles I found the number 1009699 under the frame. As this number corresponded with the number on the receipt I cautioned Bailey & said "This cycle was stolen on 14th January last What account do you give of it being in your possession, He replied "I bought it on Park Square" I took possession of the 2 cycles & brought the prisoner Bailey to the police Station where he was detained. I made further enquires & later saw the prisoner Roe & bought him to the Police Station. In consequence of what Roe said, I caused the prisoner Smart to be also brought to the Police Station. I then placed the prisoners together, I cautioned them & shewed them the cycles produced & said "these cycles have been indentified as having been stolen from a shed off Adelaide Street & I has traced them to your possession "What account do you give tehm" Roe replied "I got over the gate whilst the other 2 waited outside, I broke open the shed & took the cycles out & handed them to them. Smart replied "Thats right, I handed one to Bailey," Bailey replied "I waited outside & they handed the cycles over tome & I took them home". I then again cautioned them & charged them with being concerned together on14th January 1921 in stealing from a shed at the rear of 36 Rothesay Road a Gents & a Ladies cycle value £13.00 the property of David Howell Jenkins. Prisoners made no reply
