devising to brother Arthur all real and personal estate and appointing him sole executor, and by codicil made

devising --- scite, manor house or capital messuage called the priory, Hitchin, closes and parcels
of arable, meadow and pasture, Ippollitts, and all messuages Hitchin and Ippollitts to sister Sarah Forbes
of Bath, for life, remainder to (v) for life, then in tail male, remainder to daughters of (v) as tenants in
common, remainder to niece Dame Penelope Farnaby, then in tail male, remainder to niece Ann Radcliffe for life,
then in tail male, remainder to the daughters of Dame Penelope Farnaby as tenants in common, remainder to the
daughters of Ann Radcliffe as above on condition that they use the name of Radcliffe
--- all other estates in Hertfordshire, Kent, Cambridgeshire, Sussex and the City of London to John Radcliffe
for life with remainders as above

reciting: private Act of Parliament to vest part of the estates of John Radcliffe in trustees to be sold, 21 George III.

alias New Arbor, Kent, and messuages & lands in Brooke, Brabourne, Wye, Sevington, Ivy Church, Marson & Shutaxhurst,
Kent for 6 years, then to brother John, since deceased, father of (v), then to Ralph Radcliffe, late brother of (v),
since deceased, then in tail male, remainder to (v) in tail male, remainder to testator's niece Penelope, now wife
of Sir Charles Farnaby for life in tail male, remainder to second daughter of John Radcliffe, deceased, in tail male,
remainder to the other daughters of his brother, John, deceased, successively in tail male, remainder to brother

reciting that John Radcliffe the brother and Ralph Radcliffe the nephew are deceased, that Ralph Radcliffe the nephew
died unmarried, and that John Radcliffe (v), the nephew of the testators Ralph and Arthur Radcliffe was the only
surviving son of John Radcliffe the brother of Ralph Radcliffe, and has had no issue by Lady Frances Radcliffe his
present wife, nor was there any issue of Dame Penelope, wife of Sir Charles Farnaby, but Ann Radcliffe who had
married Charles Clarke, Esquire, then deceased, has 2 children then living - Charles John Clarke and Ann Millicent
Clarke, both infants, and Dame Penelope and Ann Clarke were the only daughters of John Radcliffe the brother, deceased.
reciting that the messuages and lands to which Edward Radcliffe was entitled were part of the messuages and lands in
Sussex which were devised by Arthur Radcliffe to John Radcliffe (v) for life, with remainders as in the Hitchin and
Ippollitts properties, and since the Sussex propery was remote and detached from the family seat of (v) and his
principle estates in Hertfordshire and Bedfordshire, devised to him by Ralph and Arthur Radcliffe, (v) has agreed
to convey the same to Thomas Samuel Joliffe of Catherington, Southampton, Esquire, for £2,901..18s..0d, the money
to be used for the purchase of estates in Bedfordshire & Hertfordshire to be settled to the same uses as the original
property devised in the will of Arthur Radcliffe
reciting that (v) wants to sell the Kent property for the same reasons and that the title could not be made good
without the Act of Parliament
the Act therefore from 24 Jun 1781 vested the property in trustees (iv) to convey Sussex property to Joliffe and to
sell Kent property
