    Parties: (i) John Robert Brown; Florence Amelia Humphreys; (ii) William Arthur Boutwood; Arthur Thurlbourn Cook; Hugh Cumberland; George Mitchell; Frank Edward Shoosmith Reciting: - J R Brown and F H Humphreys were seised of Hart Hill estate, Luton; - J R Brown and F H Humphreys laid out Hart Hill Estate for building; - J R Brown and F H Humphreys at various times sold all plots of the Hart Hill estate to various people; - every purchaser agreed to covenants, restrictions and stipulations set out in schedule; - conveyance of 26 April 1880 from (1) Henry Blundell to (2) J R Brown and F H Humphreys of land later forming part of the Hart Hill Estate reserving to (1) right of way along what became Crescent Rise between Crescent Road and right of way to Mr Waller’s house, (1) paying one third the cost of making up the road; - portion of the road from Crescent Road to Hart Hill Estate has long been constructed and is called Crescent Rise; - indenture of 12 July 1900 from J R Brown and F H Humphreys to Luton Water Company which owned a messuage called Hillfoot in Crescent Rise granting right of way over Crescent Rise and right to lay pipes; - death of F H Humphreys on 29 August 1911 having made a will on 21 September 1909 appointing his wife F A Humphreys as executrix; - proof of will of F H Humphreys in PPR on 30 October 1911; - meeting of 25 July 1913 of owners of land on Hart Hill Estate to formulate a scheme to maintain roads, paths, fences and gates on the estate and apportionment of the expense; - resolution passed requesting (i) to convey legal estate in roads and paths to trustees who had power to maintain and repair and enforce covenants in schedule; (ii) were appointed trustees Operative Part: - (i) each coveyed a moiety of (a) to (ii) Property: (a) roads and paths with fences and gates on Hart Hill Estate; (b) benefit of covenants in the schedule Habendum: - to (ii) upon trust for the owners of the land in Hart Hill Estate Provisos: - number of trustees to be not less than five with meetings of owners called to elect new trustees; - meetings to be called by not less than five owners Schedule: - respective owners contribute annually fair share of maintaining roads and footways, also fences, gates, trees and shrubs over and upon roads and footways; - no part of Hart Hill Estate to be used for manufacturing or business and no buildings other than private residences with stables, coach houses, conservatories and other offices or outbuildings of annual value as may be recited to be erected on any part of Hart Hill Estate; - no building other than fences to be erected between building lines and Crescent Rise; - nothing to be done tending yo nuisance or prejudice of owners of land on Hart Hill Estate; - respective owners to plant or erect and maintain hedges or fences; - owners of land on SW side of private road called The Drive replant baulk or bank on SW side with suitable trees and shrubs when necessary
