Scope and Content
Parties:
(i) George Draper of Hitchin [Hertfordshire], gentleman;
(ii) Edward Lawndy of Baldock [Hertfordshire], gentleman; Ann Papworth of Saint Albans [Hertfordshire], widow;
(iii) John Godfrey of Hitchin, gentleman and Ann, his wife;
(iv) Edward Sparhauke of Baldock, gentleman
Reciting:
- agreement by way of marriage settlement of 28 October 1701 between (1) Edward Lawndy and John Godfrey, (2) Ann Papworth, then of Hitchin and Ann Papworth (now Ann Godfrey, daughter of Ann Papworth) in which Edward Lawndy covenanted to Ann Papworth to convey property worth at least £60 per annum within ten miles of Hitchin to John and Ann Godfrey for the life of the longer lived remainder to issue;
- John Godfrey, by direction of Edward Lawndy and approbation of Ann Papworth, had contracted purchase with (i);
- the premises were worth £70 per annum and were within ten miles of Hitchin
Operative Part:
- Edward Lawndy paid £1,300 to (i);
- John Godfrey gave £150 to (i);
- (ii) paid 5/- to (i);
- (i) released (a)-(j) to (ii)
Property:
(a) farmhouse in Arlesey in occupation of John Impye;
(b) three closes of pasture and meadow called Home Closes containing 8 acres;
(c) messuage in Arlesey formerly in the occupation of Richard Rowel;
(d) close of pasture called Hawick containing 4 acres with close of Richard Edwards S and close late of Richard Welby N;
(e) Little Round Close of 1 acre with Winchill Field E, closes late of Thomas Browne N and S;
(f) Dame Reasons Close of 2 acres with Winchill Lane S and common baulk in Stocking Field N;
(g) Bushey Close containing 1 acre with close of Thomas Browne S, close formerly in the occupation of Richard Welby N;
(h) three closes lying together called Green End Closes containing 8 acres with close of Thomas Browne S, Stocking Field N;
(i) pieces of meadow dispersed in Arlesey containing 11 acres, 2½ roods [all adjoining fields named];
(j) 150 acres of arable in the common fields of Arlesey, Stotfold and Astwick
Habendum:
- to (ii), to the use of (iii) for the life of the longer lived, remainder to the use of their issue as in the will of John Godfrey
