    Parties: (i) John Whittingham late of St Peter in the town of Bedford but now of Leytonstone in Essex, esquire (ii) William Kingston of St Mary in Bedford, butcher (iii) Thomas Rose of Bedford, draper Reciting: - Z1644/17 - Thomas Pratt Wells by his will dated 21 March 1832 appointed Edward Chapman of Devonshire Street, Bloomsbury, London (now deceased) and (i) executors and trustees and directed that the money owing to him on the mortgaged premises should pass to his mother Frances Wells after his decease; the said Thomas Pratt Wells died on or about the 25 July 1835 - Frances Wells, by her will of 3 December 1835, appointed (i) and Alexander Sharman (now deceased) executors but made no specific request as to the disposition of the mortgage or the moneys due; the said Frances Wells died on or about the 22 January 1838 - Thomas Kingston, by his will of the 23 December 1851, devised the said mortgaged premises to his son (ii); the said Thomas Kingston died on or about the 11 September 1852 - The principal sum of £300 is still owing on the mortgage but the interest has been paid Operative Part: (iii) to pay £300 to (i) and a further £100 to (ii) to secure the transfer of the mortgage to himself Property: (a) as in Z1644/17, now in the occupation of (ii) Habendum: - property to revert back to (ii) in full if he shall pay £400 with 5% interest to (iii) by the 25 October next - if default of payment then (iii) to leave notice at usual place of abode of intention to sell and if no reply within three months then the property to be sold to reimburse the lender - if (ii) fails to keep the property insured against damage by fire then (iii) can do so and add the premium to the moneys due to himself Witnesses: - Robert Harvey Alger, clerk to Messrs Pearse & Son - William Whittingham - Theed Pearse , solicitor
