That the Indenture of Mortgage of 29 December 1898 between William Smith Cowper Cooper of the first part, Eliza Cooper of the second, and themselves of the third, was not intended and did not include the two closes of land; and declare that they have no claim as mortgagees under the Indenture of Mortgage or otherwise on the said closes of land
