In the matter of the will (8 March 1853) and codicils thereto, of Miss Frances Penyston, deceased; the Trustee Act of 1893; and Settled Land Acts 1882-1890
Upon application (by Originating Summons) of Anthony Francis Partridge (tenant in tail male in possession under a settlement created by the above will), an infant, by Edward Thomas Partridge (one of his Guardians appointed by Order dated 17 October 1893) his next friend; upon hearing the solicitors for the applicant and for the respondents Thomas Calthorpe Blofeld (as in X732/26) and Godfrey Armytage (existing trustees who are desirous of being discharged) and upon reading Affidavits of Ernest Balfour Trotter (filed 29 November 1893) and Charles Edmund Baker (filed 28 November 1893) as to fitness of William Thomas Tyrewhitt Drake to act as trustee, William Minet (filed 28 November 1893) as to fitness of Henry Tyrewhitt Staniforth Patteson to act as trustee, Lewis John Berger (filed 2 December 1893), Edward Thomas Partridge (filed 6 December 1893), and Walter Edward Moore (filed 9 December 1893); and the consents of William Thomas Tyrewhitt Drake and Henry Tyrewhitt Staniforth Patteson to act as trustees verified …
… Judge appoints Henry Tyrewhitt Staniforth Patteson of Postwick near Norwich (Norfolk), esquire and the Reverend William Thomas Tyrewhitt Drake of Gaddesden rectory, Hemel Hempstead (Hertfordshire), clerk, trustees of the will of Harriet Penyston in lieu of Thomas Calthorpe Blofeld and Godfrey Armytage and also as trustees for the purpose of the Settled Land Acts
Order that the costs of the applicant and respondents of this application be paid out of the income of the property subject to the said settlement (such costs to be taxed by the Taxing Master [Mr Shearne] as between solicitor and client) - related certificates, dated 12 March 1894, appear in the left hand margin on the face of the document
