- Scope and ContentAbstracting as follows: [see also X732/22 xiv)] Indenture of Conveyance from Francis Astry, D.D., brother and heir and also administrator of the goods and chattels of James Astry of Wooden, esquire, who died intestate and sans issue, to George Draper and his heirs, of: 16 Jan 1718 a) 3 closes called Pond Wadlows. Middle Wadlows and Further Wadlows (20 acres), all formerly in the possession of William Langford and now or late of William Godfrey, in the parishes of Harlington and Toddington: see X732/9 j) b) 4 acres in middle Mead in Harlington, now or late of William Godfrey: see X732/9 p) c) cottage or tenement with close adjoining thereto (4 acres) in Gossle in the parish of Harlington: ?in X732/9 Habendum: to George Draper and his heirs to the intent that he shall stand and be perfect tenant of the freehold of the said premises, inter alia, to the intent and use a common recovery may be had and suffered of the premises and it was declared that the recoveror and his heirs should stand seised of the premises to the use and behoof of Francis Astrey, his heirs and assigns for ever NB. Abstract records that this Indenture was Tripartite (Robert Southam was the third party) Recovery suffered accordingly by the parties no date Settlement of the premises inter alia by Francis Astry upon his marriage with Mrs Susanna Walklate: see X732/10/1-2 10 Feb 1718 Dr Francis Astry's payment of charges on the premises, inter alia, due to his brother and 2 sisters and release from them: see X732/11 11 Feb 1718 Death of Francis Astry: as abstracted in X732/22 xvii) 30 Oct 1766 Fine of premises referred to (inter alia): see X702/4 a) - b) 1767 Deed of covenant to declare the uses of the fine: see X732/21 1767 Indenture of Marriage Settlement of 5 parts 18 Jan 1787 i) Mary Penyston, widow of Fairmeadow Penyston, deceased ii) Francis Penyston, only son and heir of Mary Penyston and Fairmeadow Penyston iii) Rebecca Asheton, second daughter of Ralph Asheton of 'Curedale' (Lancashire), esquire, deceased iv) Francis Page, esquire v) William Asheton and James Musgrave, esquire Reciting the marriage agreed on between ii) and iii) and for consideration therein expressed the said premises were, amongst various other lands and hereditaments, granted and conveyed to v), their heirs and assigns, for ever to several uses following: - to ii) for life, remainder … - to v) 'to support etc. and from and after his decease' - to use that iii) shall receive an annuity of £500 for her jointure and in lieu of dower - to use of v) for 200 years to be computed from the day of the marriage for payment of jointure and from and after the expiration of the said term - to the use of the 1st son of the body of ii) on the body of iii) and the heirs male of such son - to the use of 2nd, 3rd, 4th, 5th, and all and every other son and sons successively according to priority of birth and their several heirs male and in default of issue - to the right heirs of ii), for ever (note here refers to memorandum on the dorse of the abstract, 'Provided nevertheless that from and after the decease of the said Rebecca Asheton [?] and after payment of said Annuity and all arrears and when the payments [?] thereby declared [?] are fully satisfied said term should cease') Proviso and agreement between parties that notwithstanding any of the limitations, uses, estates and trusts limited, expressed and declared, it shall be lawful for v), their survivors etc. at any time(s) after the solemnization of the said marriage with the consent and approbation of ii), testified in writing under his hand and seal, to make sale or dispose of or to convey in exchange for in lieu of other manors, messuages, lands and hereditaments in fee simple in possession to be situate somewhere in England, all or any part of the said several manors or lordships, messuages, farms, lands, tenements, hereditaments and premises granted and released above and the fee simple and inheritance thereof to any person(s) and his and their respective heirs and assigns either together or in parcels or by public auction or sale or private contract for such price(s) in money or for such equivalent recompense in manors, lands and hereditaments as to v) or the survivors of them or the heirs and assigns of such survivors shall seem reasonable (note on abstract here 'executed by all parties') End of abstracted deeds of title Endorsements: 'Abstract of Title to several Pieces of Land in Harlington and Toddington: County Bedford, July 12th 1799 Sent a Copy to Leonard Hampson, attorney by Coach from Golden Lyon, Luton, St John Street, Bedford'.
