- Scope and ContentAbstracting as follows: i) Indentures of Lease and Release by way of Settlement (see X732/1 and X732/4) between James Astry, esquire of the first part and Sir Thomas Penyston and William Sheppard, esquire of the other part 15/16 Jun 1676 Recites, inter alia, that James Astry, in consideration of a marriage had between him and his then wife Anne, sister to Sir Thomas Penyston. and of her marriage portion and a jointure to be made for Anne and settling the manor and hereditaments (viz. as in X732/1 a) - m) and all other his manors, messuages, tithes, lands and hereditaments in Wadlow, Harlington, Toddington, Woodend, Gossle End and Westoning), released the estates therein mentioned to Sir Thomas Penyston and William Sheppard to the following uses (summarised also in greater or lesser detail in X732/4 and X732/11) - b); d); m); a messuage near the tithe barn [Westoning] in the possession of Charles Poulton, a messuage in Westoning in the occupation of Thomas Malcombe, a messuage and close in Westoning in the occupation of James Church, a messuage and close in Westoning in the occupation of [ ] Gilby (viz. a messuage or Inn called the Crown in Toddington with a close near the same), a cottage in Toddington in the possession of Henry Roberts, a messuage or farmhouse in Harlington in the possession of John Leaper with the lands belonging thereto called Hartfield, a messuage or farm in Westoning with all the land belonging thereto in the possession of William Pepper containing 12 acres with a Smith's shop in or near the same (all being ?part of c)) … … to James Astry for life, remainder to Anne for life for her jointure and in lieu of her dower, remainder to the heirs male of James Astry on the body of Anne, remainder to the heirs male of James Astry, remainder to the heirs and assigns of James Astry for ever - a messuage in Harlington in the possession of Thomas Cole; g); f); the Dovehouse Close; 30 acres of land, meadow and pasture in Toddington called Redhill pasture [?;]. Hammonds, Lea Close, Norton Pightle, Great Wadlows and Plowed Wadlowes; and 30 acres of arable land in Westoning in the possession of Thomas Lilborne … … to James Astry in fee - a) and 'all other the messuages, lands and premises whereof no use is before limited' (viz. presumably ?c), e), h), j), and k)) … … to James Astry for life, remainder to the use of William Burre, gentleman, and Robert Parratt, esquire, their executors etc., for 99 years upon trusts declared (viz. raising by rents, sale or mortgage of portions and maintenance money for daughters of James Astry by Anne: see X732/4 and X732/11), remainder to the heirs male of the body of James Astry on the body of Anne, remainder to the heirs male of the body of James Astry, remainder to the heirs and assigns of James Astry for ever ii) Indentures of Fine levied by Sir James Astry and his wife Dame Anne to Richard Freeman, esquire, of the rectory of Westoning and all tithes of corn, grain and hay etc. Trinity term 5 William and Mary (1693) iii) Indenture of Mortgage by Demise for 500 years at peppercorn rent, to secure £400 with interest, from Sir James Astry and Dame Anne to Hester Webb, spinster, of the rectory and parsonage of Westoning under a proviso to be void on payment of £410; and ii) is declared to enure to the use of Hester Webb her executors etc., for the said term of 500 years for corroborating the same and, after determination of that term, to such further uses as should be declared by the mortgagors 1 Aug 1693 iv) Indentures of Lease and Release as recited in part in X732/6 20/21 Nov 1693 Abstract here: … notes that the land conveyed was the manor of Wadlow and all other the premises comprised in the Settlement of 1676, 'the whole of Hardings Close being conveyed by these Deeds whereas a third part of them only was conveyed by those of 1676' [see X732/1 h) and X732/6 h)] … includes the following recitals: - that by the Settlement of 1676, certain premises were limited to Sir James Astry and his heirs viz. (as above) whereby he was seised thereof in fee simple - that Sir James Astry and Dame Anne had levied a fine of the rectory of Westoning and thereby barred all entails thereof (see above) - that the manor of Wadlow and other premises (except the rectory of Westoning and the premises limited to Sir James Astry in fee as aforesaid) remained entailed by the Settlement of 1676 … and records that for barring the said entails it was covenanted that Sir James Astry and Dame Anne should before the end of Hilary term next levy a fine of the said entailed premises to Dormer and Freeman (see X732/6) which fine was declared to enure to the uses, and subject to the trusts and proviso etc. recited above in X732/6 v) Indenture of Assignment between Hester Webb of the first part, Sir James Astry and Dame Anne and James Astry, esquire, their eldest son, of the second part and Charles Cutts of the third part whereby after reciting that there was due to Hester Webb for principal, interest and charge £443..10s upon the Mortgage as in iii), Hester Webb (in consideration of £443..10s paid to her by Charles Cutts), by the direction and appointment of Sir James Astry and Dame Anne, assigned to Charles Cutts the rectory of Westoning and all deeds etc. 22 Jul 1698 Habendum: to Charles Cutts his executors etc. for the remainder of the said term of 500 years And in consideration of £6..10s paid to Sir James Astry by Charles Cutts, Sir James Astry, Dame Anne and James Astry demised the said rectory to Charles Cutts Habendum: to Charles Cutts his executors etc. for 500 years more to commence from the end of the first term at peppercorn rent subject to redemption on payment of £477 and interest at 2 payments vi) Indorsement on the last deed whereby (after reciting that Charles Cutts had lent Sir James Astry and his son James another £1,750 so that the total principal lent by Charles Cutts amounted to £2,250 for securing which the mortgagors had agreed to suffer a recovery of the rectory and other lands and to grant Charles Cutts a term of 500 years thereof; and that it was agreed that the residue of the said first 500 year term and the term of 500 years granted by way of future interest should be assigned for the benefit of Charles Cutts to protect the said rectory, tithes and hereditaments from mesne incumbrances), in consideration of 5s Charles Cutts assigned the said rectory and all his estate, interest and term of years therein to Richard Richardson, gentleman, his executors etc. in trust for and for the benefit of Charles Cutts his executors etc. vii) Indentures of Lease and Release: see X732/3/1-2 3/4 Jul 1701 viii) Exemplification of Common Recovery: see X732/5 Trinity 13 William III ix) Indenture of Agreement declaring uses: see X732/4 4 Jul 1701 x) Tripartite Indenture of Assignment: see X732/6 22 Jul 1701 xi) Indenture of Assignment: recited in X732/7 12 Jun 1706 xii) Indorsement on xi): also recited in X732/7 12 Dec 1711 xiii) Tripartite Indenture of Assignment: X732/7 7 Apr 1718 xiv) Tripartite Indenture (see also X732/25 i) between Francis Astry. D.D. (brother and heir and also administrator of the goods and chattels of James Astry of Woodend, esquire, who died intestate and sans issue), George Draper and Robert Southam whereby Francis Astry conveyed the said manor etc. to George Draper and his heirs to the intent that George Draper shall and may stand and be perfect tenant of the freehold of the manor etc. to the intent and use that a Common Recovery may be had and suffered of the same; and it was declared that the recoveror and his heirs should stand and be seised of the manor etc. to the use and behoof of Francis Astry his heirs and assigns for ever 16 Jan 1718/9 xv) Francis Astry made a Settlement of the said manor and premises on his marriage with Susanna Walklate: see X732/10 10 Feb 1718/9 xvi) Payment by Francis Astry of £1,100 charged on the premises to his younger brother and 2 sisters and release from them; and the assignment of the term, created for that purpose, to a trustee: see X732/11 11 Feb 1718/9 xvii) Death of Francis Astry sans issue and his will, 2 October 1761, in which he gives all his estate to Fairmeadow Penyston of Cornwell (Oxfordshire), esquire, his heirs and assigns for ever and appoints Fairmeadow Penyston his sole executor 30 Oct 1766 xiix) Fairmeadow Penyston levied a fine of the said premises (see X702/4 a)-b)) and a deed of covenant in the same year between Fairmeadow Penyston and Thomas Walker: see X732/21 Easter 1767
