note attached 'A Deed dated 9th October 1878 to much the same effect as this had been previously agreed but if I remember rightly, this Deed was thought unstable because under the earlier Deed the cuts to Mr M Ware's share in the rent charges was treated as part of his realty whereas it appeared when the subject was further considered upon the decease of Mr John Ware that it should be treated as personalty, CTW'
