i) James Thomas Ware, Tilford, Surrey, esquire Martin Ware, Lincoln's Inn, Middlesex, barrister (called Martin Ware junior) Charles Tayler Ware, Great Winchester Street, London, esquire ii) Ellen Ware, Torquay, Devon, widow John Frederick Hall, Earleigh Court, Berkshire, esquire iii) Reverend Henry Ware, vicar of Kirkby Lonsdon [Lonsdale], Westmoreland iv) said Martin Ware junior now in consideration of £1,762 retained by i) out of share of iv) in surplus residue personal estate of Martin Ware senior i) with consent of ii) and iii) declare that i) shall hold in trust for iv) … 918/2205th shares etc. signatures of all witnesses: Thomas Beagley, Charles Martin Ware, James Steadman, Lucy T Ware, Philip Mortimore note attached 'A Deed dated 9th October 1878 to much the same effect as this had been previously agreed but if I remember rightly, this Deed was thought unstable because under the earlier Deed the cuts to Mr M Ware's share in the rent charges was treated as part of his realty whereas it appeared when the subject was further considered upon the decease of Mr John Ware that it should be treated as personalty, CTW'
