    i) James Thomas Ware, Tilford, Surrey, esquire ii) Martin Ware, Lincoln's Inn, Middlesex, esquire iii) Charles Taylor Ware, 7 Great Winchester Street Buildings, London, esquire iv) Ellen Ware, Torquay, Devon, widow said Martin Ware John Frederick Hall, Earleigh Court, Berkshire, esquire v) Reverend Henry Ware, Kirkby Lonsdale, Westmoreland, clerk Martin Ware, late of Gordon Square, Middlesex, esquire, deceased, by his will dated 18 July 1868 devised all his real estate to i), ii) and iii) in trust for sale (except property near Tilford and Munday's farm) and also surplus of personal estate to pay to his son i), the amount by which the real estate at Tilford should be less than 1/3 part value of said estate and of Munday's farm. Remainder and surplus in trust for sons i), ii), Joseph Maitland Ware and v) in equal shares testator died on 10 October 1872, will proved on 8 November 1872 (Principal Probate Registry) testator was seised of yearly rent charge of £4..14s issuing out of property in town of Bedford and of a yearly rent charge of £206..18s out of other property in Bedfordshire 1st rent charge subject to redemption at cost of £176..6s..8d 3% Consols 2nd rent charge subject to redemption at cost of £7,586..6s..8d 3% Consols said testator was entitled to 918 two thousand two hundred and fifth parts in said 2 rent charges said Joseph Maitland Ware made will dated 28 May 1863 and appointed wife, said Ellen Ware, brother, said Martin Ware and said John Frederick Hall as executors. He gave (inter alia) personal estate to iv) in trust to convert to money (subject during her life, to wife's consent). He died on 21 September 1868 leaving son and 4 daughters. Will proved 24 December 1868 (Principal Probate Registry) all monies payable to i) have been satisfied out of personal estate ii), iii), v) and iv) have agreed by way of family arrangement that parts to which said testator, Martin Ware, was entitled of said 2 rent charges shall be taken of a value of £1,762 and shall be taken by ii) in satisfaction of a like part of his share in estate of testator so is agreed that i), ii) and iii) as trustees of estates of Martin Ware deceased shall hold … 918/2205 parts in said 2 rent charges in trust for ii) absolutely signatures of all endorsed: witnesses: Herbert J Wood, C Gilbert, Francis E Hahn 9 Oct 1878 deeds marked '.. shares in 2 rent charges payable out of Howberry Estate in the Town and County of Bedford'
