Parties:
(i) John Reynolds of Husborne Crawley, farmer;
(ii) William Green of Hockliffe, grocer
Reciting:
- R6/19/3/74;
- death of John Brinklow in May 1800 and proof of his will in Archdeaconry Court of Bedford on 26 May 1800;
- John Brinklow left two children living at his death: Elizabeth, who married John Reynolds; Sarah, who married William Green and Susannah who was pregnant at the time of his death of a daughter later called Mary;
- death of Mary Brinklow in 1815 intestate and unmarried leaving as next of kin Susannah Brinklow, Elizabeth Reynolds and Sarah Green;
- death of Elizabeth Reynolds in August 1836 and R6/19/3/86;
- recent death of Sarah Green;
- Susannah Brinklow survived Alexander Deacon and died in February 1838;
- R6/19/3/87;
- on 31 August 1838 (i) filed a bill in Chancery against (ii) praying: to be declared entitled to one third part of the leasehold and residuary personal estate of John Brinklow and one third part of the one third part of the leasehold and residuary personal estate of Mary Brinklow; that an account be taken of the leasehold and personal estate of John Brinklow received by Susannah Brinklow and by (ii); an account of how the personal estate had been applied and disposed of by Susannah Brinklow and (ii) and what part remained undisposed of;
- (ii) had answered (i)’s bill;
- to prevent further litigation between (i) and (ii), (i) had agreed to accept £900;
- (i) and (ii) had agreed that the suit in Chancery be dismissed, each paying his own costs
Operative Part:
- (ii) paid £900 to (i);
- (i) agreed to execute a conveyance to (ii) [R6/19/3/89]
