“Qu Whether Whitebread hath a good Title to the Freehold & Leasehold premises”
“I am of opinion that Mr Whitbread hath (as against John Morrison & Lydia his wife) a good & Clear Tile both to the Freehold & Leasehold Premises; And that his Title to the Freehold is Warrented by Colliers Case in Lord Cokes 6 rep page 16 with this Difference That by vertue of the Words (for ever) which in a Will make an estate of Inheritance or Fee Simple; Mr Whitebreads Case is by much the Stronger than Collyers Case. R Acherley”.
