    Letter to Thomas Wing from Eagles & Son: “If the second recital as altered is so very objectionable it may stand as first framed, but with regard to the Alterations of the third we presume as Mr Bennett particularly told Mr T Evans (which if necessary could be proved) that he would not make any offer but if Mrs Evans chose to abide by an Arbitration the Duke would submit and recommended such course, you will not persist in your objection thereto. It is also important to Mrs Evans that she should have the like power of compelling the production of papers &c in the possession of Mr Davis and that he should also, as the Duke will, under the Agreement have the means of calling upon her, Mr Bennett of himself knows nothing relative to the business during Mr Evans’ life, as we conclude it is not the wish of His Grace or yourselves to withhold any testimony or Evidence which we may deem important to the Interest of our Client will you undertake that Mr Davis shall attend the Arbitration if required by us or the Arbitrators and and produce the rolls and any other papers &c he may have in his custody which may be called for or request him to enter into an Ingagement to that effect, if you or he will give such an undertaking we will consent to the additions made to the Agreement as to Mr Davis being erased. We shall be glad to hear from you in a post or two”.
