- Scope and ContentProbate of the Will of Reverend Leonard Towne, deceased, Camden Town, Middlesex, clerk - to friends Reverend Dr Staunton, of Staunton, Nottinghamshire, Reverend George Gordon, clerk, Rector of Muston, Leicestershire, Reverend Thomas Norris, Harby, Leicestershire, clerk, Lewin Cholmley Esq., Easton Hall, Lincolnshire and Richard Bartram Esq., Bottesford, Leicestershire, and to his son, Leonard Elye Towne - Manor of Colmworth, Bedfordshire, and all other lands in same county (except those comprised in daughter's marriage settlement, or held by him in trust, or by way of mortgage etc) in trust to raise £2,200 of satisfy part payment of the purchase money of hereditaments hereinbefore devised, which sum was the produce fo certain monies settle on his marriage, then invested in mortgage securities and since called in with interest of 5% from the day of his death and also sum of £2,000 secured by a mortgage of part of the hereditaments hereinbefore devised. This sum was part of the produce of certain estates in Kilvington, Nottinghamshire, settled on his marriage and since sold, with all arrears on interest due on said £2,000, and also all sums owing at his death (except annuity of £20 secured by bond to Elizabeth Hole, Durham) - to Sarah Jones, Camden Town, widow: £500 to be paid within six months of his decease and an annuity of £250 to be paid on the same day as similar annuity already secured - also to trustees (said friends and son): real estates upon trusts. For use of Thomas Norris and then for Sarah Elye Norris and then for children. If no children, the moiety in trust for Leonard Elye Towne and children. If no children, and also as to other moiety, in trust for 2nd son, John Elye Towne, clerk, for his maintenance and support as trustees think fit, to be paid so as not to be affected by his debts, and then to his children. If no children, then moiety in trust for Leonard - entirety of property upon future trusts: one moeity for Mary Susannah Hole of Durham for life, other moiety to Louisa Hole, for life, then to John William Jones, late of Bow Lane, Cheapside, vintner - lands at Surfleet, Gosberton and Kirton in Holland, Lincolnshire (subject to mortgage to executors of late Gervas Boot) in trust for Sarah and John William Jones for 200 years. Then to trustees for John Elye Towne for his maintenance and then to his children. If no children, then one moiety to Leonard and the other to Thomas Norris (etc) then to Mary Susannah Hole, then to Louisa Hole, then to John William Jones. Property to John William Jones and Sarah Jones for 200 years are on trust form them to raise annuity of £20 for Elizabeth Hole and also annuity of £30 during joint lives of Elizabeth and M S Hole and after death of Elizabeth, annuity of £40 for M S Hole. Other Provisions - copyhold estates in Kirton in Holland, in trust, under such conditions, as concern his freehold estates - reversion of Manor of Utterby, advowson and all tithes and tenths of par of Utterby and all lands in par - all other real estate not otherwise disposed of, in trust for maintenance of John Elye Towne, then to Thomas Norris, then to Sarah Norris, then to Susannah Hole, then to Louisa Hole, then to Reverend Richard Wright of Wrangle, Lincolnshire - anyone who succeeds to Utterby estates (except John Elye Towne) shall take the name and arms of Elye - real estate held by testator in trust or by mortgage, to Richard Bartram and Thomas Norris Leonard Elye Towne appointed sole executor Power to appoint new trustees Witnesses: Joseph Dunn, Grays Inn George Thomas White, Inner Temple Thomas Binns, Lincoln's Inn 6 May 1822 Republished as his will Witnesses: Mary Towne Samuel Foyer George Thomas White 13 October 1824 With codicil. Leonard Towne, now of Woolsthorpe, Lincolnshire - freehold lands in Surfleet, Gosberton and Kirton - copyhold lands in Kirton Trusts now revoked and property to trustees on trust for sale. Proceeds to satisfy debts and surplus to Leonard Elye Towne. Manor of Colmworth has been charged with payments of £2,200 and £2,000, secured by mortgage of part of the estate, now said sums (except annuity for £20 to Elizabeth Hole) to be discharged out of proceeds of estates at Surfleet, Gosberton and Kirton. Estate also charged with another annuity of £30 to Elizabeth Hole and Mary Susannah, her daughter, jointly, and after decease of Elizabeth, £40 to Mary Susannah for her own use. Same with Louisa Hole. Witnesses: Elizabeth Kemp George White Edward Willan 29 June 1826 Probate (PCC). Sworn at under £3,000 23 February 1827 With receipts for annuities for E Hole and M S Hole and by E Hole and L Hole. With receipts for stamp duty on the back. July 1828 With certificate of death of Mrs Hole on 8 August 1847 and that Miss Hole and Mrs Mitchinson are still living. J Todd, Incumbent of Shincliffe. 31 August 1847 Copy of letter from [Mrs Norris] to Miss Hole concerning the payment of the annuity now her mother has died. 1 September 1847 With letter from M S Hole, 56 South Street, Durham, to Mrs Norris acknowledging receipt of halves of two notes - half a year's annuity. 3 September 1847
