- Scope and ContentParties: (i) Eddie Horace Shrive (also known as Edward Horace Shrive) of The Old Rectory, Millbrook (ii) Veronica Beatrice Woodward of Brookside Farm, Maulden, spinster, and David Oliver Woodward of Speedwell Farm, Woburn (iii) William Sutherland of Meadowbank, London NW3 Reciting: - conveyance of 27 July 1973 (see X948/2/MIL/5/10) together with additional compensation of £3500 paid to (i) by (ii) - covenant entered into by (ii) to carry out fencing and road construction works - fencing works completed but not within the time limit specified - road construction works only partly completed - proceedings commenced by (i) against (ii) in Chancery Division of the High Court of Justice - agreement between (i) and (ii) that covenants be varied and the action withdrawn - agreement by (ii) to sell the property together with other land to (iii) Operative part: In consideration of sum of £500 and additional £250 paid by (ii) to (i) as contribution towards costs, and in consideration of covenant below (i): - releases and surrenders covenants contained in 1973 conveyance - covenants to withdraw legal action - releases and waives any claim against (ii) for breach of covenant - will keep (ii) and (iii) indemnified against any claimby (i)'s tenants or licences or otherwise arising from breach of covenant (ii) and (iii) jointly and severally covenant with (i): - to make up a properly kerbed and metal roadway of minimum width 13 feet at their own expense within 6 months of written notice by (i) - to maintain the roadway after completion - to maintain the fences and gates constructed by (ii) - to allow (i) access to his adjoining property from the road - to ensure free flow of the brook over which the road will pass
