- Scope and Contentstates among other things: a) The true construction of the Will of Edmund Powers is that debts are validly charged on his real estate. Such debts ought to be paid out of the real estate, which is described in the Deed of 22 January 1885 and other real estate devised by his Will. b) Defendants Fred Archdale etc claims due to them on Account of Mortgage of 31 October 1879, Mortgage of 5 September 1883 AND Equitable Mortgage of 16 May 1879 (The sums claimed are listed in the second schedule of the Chief Clerk's Certificate, dated 23 December 1891 (HF41/7/9/27) and interest since 6 December 1888 AFTER Credit for rents received from properties included in deed of 22 January 1885 and three osier beds at Langford: £4,800 deleted; replaced by £4,000 c) F.Archdale undertakes to pay Law Life Society the excess of the above £4,000 over the amount found due to Archdale etc on the accounts of 1) & 2) BELOW and interest on such excess d) ORDER Plaintiff (Law Life) to pay £4,000 e) Accounts to be taken: i) what is due for Principal on Security of above mentioned mortgages & for costs of Action in so far as the Action is to redeem Mortgages. ii) Account of Rent and Profits of Testator's real estate, comprised in deed of 22 January 1885 AND Osier Beds at Langford since 6 December 1888 iii) take account i) from account ii) AND certify the Balance. f) SELL a) pieces of land listed in parts 1) & 2) of the Chief Clerk's Certificate of 23 December 1891 b) Spectacles, Biggleswade (deleted) c) Three pieces of land at Langford Note by Mr Warrington: Archdale etc do not intend to sell the Spectacles and Haling Way asks for instructions as to how Biggleswade & Langford Mills & land.are to be divided into lots for Sale by Auction Two accounts of Proceeds i) Biggleswade Mills Account ii) Langford Mills Account iii) Holme Mills Account iv) Cottages at Clifton & Biggleswade Account Account of what is due to Law Life Society of 3 August 1871, including such part of the £4,000 above Instructions for the taxing of Costs July 1892 Alterations on behalf of the Defendants 3 August 1892
