Powers & Co to Easton Money paid as an advance on 270 Quarters of Wheat ex "Lena"; Powers & Co to pay 5% pa.14 December 1883 Question turns on whether £725, and £459 advanced were both advanced to Charles Powers and Company. Advised Saffery would be satisfied by production of their clients books to prove money advanced to Charles Powers and Company 4 Dec 1884 Copy of receipt for 2 sums and of payment into the bank; Stibbard etc. to Hooper and Company; received telegram “the 2 sums named in your letter were paid but placed to Powers and Sons credit with Powers and Company” seems Powers and Company responsible “in other cases we have seen in this matter Powers and Wright have borrowed the money which they have paid sometimes to Powers and Company and sometimes to Powers and Sons” 5 Dec 1884 Copy of letter, Saffery Hawly and Son, Bank Chambers, Tooley Street, London Bridge SE. to Stibbard Gibson and Company; surprised by letter, issued writ v. Charles Powers and Company. “determined not to be shifted by the person to another by the Defendants” 5 Dec 1884 Stibbard etc. to Saffery; not seen any document whereby Charles Powers and Company liable to your clients (Easton), sorry issued writ as Charles Powers and Company quite prepared to pay the account without one 6 Dec 1884 Stibbard to Hooper and Company; Edmund Frederick Powers signed name of Charles Powers and Company advance to them, ie. they are liable. “Edmund Frederick Powers seems to have taken one or both of the cheques and paid same into the account of Powers and Sons, a most improper proceeding and one for which we should think he would be criminally liable” 9 Dec 1884 Saffery etc. to Stibbard, Gibson and Company; sending writ in Eaton v. Charles Powers to them as not heard from Hooper 12 Dec 1884 Saffery etc. to Stibbard etc.; won’t forego costs of action. Unless paid forthwith will proceed with action as far back as August Mr Easton was in communication with Stibbard etc. regarding claim; matter procrastinated till writ was issued 17 Dec 1884 Copy Saffery to Stibbard; only went on with action because Hooper and Company repudiated debt
