    Reciting conveyance of 28 November 1853 a) Josiah Wheeler, Leighton Buzzard, gentleman b) Charles Ridgway, Leighton Buzzard, draper Thomas Kent, Leighton Buzzard, ironmonger John Marshall, late of Leighton Buzzard, mealman, and now of Heston, near Hounslow, Middlesex, baker c) said Charles Hidgway and Thomas Kent d) John Birdsey, Leighton Buzzard, dealer in earthernware Reciting the will of Josiah Wheeler, senior, dated 4 July by which he left property to wife Mary Wheeler with power to help son, a) as trustees and wife think fit wife and c) made executors etc and given rights and means to protect any property from parochial depredations contrary to usual indulgencies of the Township Josiah Wheeler senior died on 15 September 1840. Will proved (Prerogative Court of Canterbury) on 8 August 1842 whereas at court held for Manor on 31 October and 1 November 1844, Mary Wheeler and c) were admitted tenants (except angular piece of land - part of said close - to which James Eagles and wife Mary were admitted tenants at a previous Court on surrender of Josiah Wheeler and wife) to property of Josiah Wheeler Reciting also the award of the Leighton Buzzard enclosure commissioners dated 5 May 1848 by which they awarded to Mary Wheeler - (in lieu of land late Mary Stones - being plot of land described in first schedule) one plot of land in Summers Piece, Leighton Buzzard (2 acres 1 rood 17 perches including public footways) West - Sandy Lane . North - aibtment awarded to Francis Goodman East - Mary V/heeler (being next described piece of Iand) South (part) Claremont now belonging to Thomas Kent West (remaining part) and South (remaining part) - old enclosure called Butlers belonging to Grace Millard - (in lieu of lands and rights of common in Leighton Buzzard late Francis Tompkins, being 2 acres of arable in 2nd part of schedule) one plot of Iand adjoining Stepping Stones Road (2 acres 36 perches) East - Stepping Stones Road South - Claremont. West - plot of land next described North (part) & West (part) - Francis Goodman North (remaining part) - John Birdsey Mary Wheeler died on 11 August 1848. Will dated 4 February 1848 by which she devised all her real estate to such uses as son a) and her friends b) should appoint. Will proved (Prerogative Court of Canterbury) on 20 November 1848 a) and c) lately sold to Thomas Kent a slip of land containing 13 perches being part of South side of land containing 2 acres 36 perches d) has agreed to buy said lands for £60 and an annuity of £28 to be paid bv direction of a) to c) during life of a) Doubts have arisen as to legal effect of will of Josiah Wheeler, senior so c) at request of a) agreed to surrender the property as hereinafter mentioned d) by bond of even date at request of a) have become bound to c) in sum of £500 to be void on payment of the annuity now in Consideration of £60 to a) paid by d) and annuity of £28 a) with consent of b) direct that said plots should go to d) to be held according to the custom of the manor c) surrendered said property to use of d) schedule - the Lammas Close (2 acres) next Goose Green Lane (west) and land of Henry Millard and afterwards John Millard (south) - 2 acres arable heretofore Poyntons (3 roods) in Grovebury Field, both in Leighton Buzzard Signatures of a) and b) and receipts now said John Birdsey was admitted to said property Quit rents - 8d and 8½d
