Scope and Content
reciting that i) are owners of 46 - 54 (even), High Street, and 2 and 4 Silver Street, Bedford including Prioratus Arch in Old George Yard (as on plan attached)
ii) own, subject to leases, nos 34 and 36 High Street, Bedford reciting lease of 1 December 1948 and reversionary lease of 18 November 1950 between Capital and Counties Property Co. Ltd and iii), the property of ii) was demised to iii) for 70 years from 1 December 1948.
i) obtained on 12 July 1955 planning permission for re-development of 46, High Street including a window overlooking property of ii) which will infringe the rights of ii) as to light and air appurtenant to windows in North elevation of warehouse now ii) and iii) agree that i) may have liberty to carry out said redevelopment; right of light and air of ii) and iii) shall be extinguished in regard to said warehouse; said new windows to open inwards unless by opening outwards such windows do not overhang the property of ii)
i) agrees to pay £200 to ii) and £300 to iii) in full compensation of such loss
i) to pay 1s p.a. as acknowledgement that its enjoyment of the access of light is by permission of ii) to remain in force until determined in writing
