    Thomas Evans: about 9pm she saw Joseph Kendall come into his master George Morgan’s’ shop as he was putting up the window shutters on the outside of the shop. He saw Kendall, through the window, take up a piece of butter from the counter and put it in his pocket. He went to inform his master of what he had seen and then returned to the shop and charged Kendall. He took the piece of butter from Kendall’s pocket and laid it on the counter. Hs master took the butter and wrapped it up in paper. George Morgan: he was a baker and kept a grocer’s shop. About 9pm his journeyman came into the kitchen and said he had seen Joseph Kendall take a piece of butter from a dish on the counter in the shop. He saw Thomas Evans take a piece of butter from Kendall’s pocket. He wrapped it in paper and wrote the word Kendall upon it. He delivered it into the hands of Whittamore the constable. William Whittamore: about 9pm he was sent for my George Morgan to take a person into custody for stealing some butter. He went immediately and as soon as he got there by took charge of Kendall. Mr Morgan out a piece of butter into his hands which he said had been taken from Kendall’s pocket. Statement of the accused: nothing to say.
