    plaintiff's bill: the will of their father may be performed and debts and legacies paid to them, recite will RO10/22 proved by Bridget who afterwards died scope of bill: to have said will performed; to have defendants take on their trust and pay legacies etc. and that defendant Venables be ordered to join in the sale of said premises defendants' answer: Thomas Beverley:- does not know the value of the testator's lands and debts, refused trust Thomas Homersley:- is willing to accept trust (being saved harmless by decree of this court) Venables Staunton:- willing to see will performed and to join in the sale counsel of defendant Homersley:- has contracted for sale of lands but many debts might be left unpaid to which he would be liable Court decree: Sir Thomas Beverley to release to Thomas Homersley all right in said lands. Homorsley to sell lands, Venables to join in conveyance; Homorsley to pay plaintiffs and defendant Venables their legacies; Master of this court to call creditors of said Dr Staunton; Homersley to pay overplus to said Leonard and George and master is to make account of rents and profits of said Homersley out of said premises from death of said premises and if surplus remaining in hands of Homersley insufficient to meet debts each of the legatees shall contribute proportionally. Costs to be deducted out of said moneys Copy received by Thomas Traherne for use of Mr Browning 6 January 1707 [?09] Endorsement: No.(16)
