On motion of Mr Whitlock (defendant's counsel) and on reading order of 25 November last whereby Exceptions put in by the defendant to the award of certain referees would be heard the 2nd day for hearing Exceptions in this term, but hearing the said Exception is a determining of the cause and so prohibited by the proclamation whereby the defendant will lose benefit of said order. Order that the Exception is to be heard on the 2nd day of Exceptions of next term, meanwhile the Injunction formerly granted is to be confirmed
