- Scope and ContentBy order of 12 July last it was ordered that those in possession of the lands in question at the time the bill was filed should keep the same until the hearing and the tenants who had sowed the premises could reap their crop and keep the rents thereof in their hands until the hearing and both sides were to examine the Witnesses during the vacation and the cause was to be heard next term The matter opened today to the Lord High Chancellor of England plaintiff's counsel: Mr Calthorpe, Mr St Fountayne defendant's counsel: Mr Perks, Mr Reversham plaintiff's counsel moved that Knight and Harvey who are in possession of the land in question may quit the possession thereof or else pay their rent and arrears to the plaintiff or else bring the same into court for that they are like to become insolvent and are 10 years rent in arrears to the plaintiff and have carried away their corn from the premises plaintiff could not execute his commission for the examination of the Witnesses during the vacation because his clerk had mistaken one of his commissioners' names and made the same "Richard Daniell esquire" whereas the said Mr Daniell's Christian name is Thomas and the plaintiff has been very sick for the most part of this vacation, as by Affidavit it appears, therefore it was prayed that the plaintiff may be at liberty to renew his commissioners and alter the said Christian name of the said Daniell and have further time given to examine his Witnesses Foreasmuch as Richard Conquest, deceased late father of the now defendant Richard and v. whom the otriginal bill was, did by his answer confess to having 3 several deeds in his custody which concerned the lands in questuion and which deeds the defendant Mildred acknowledges to be in her custody; it was prayed that Mildred may produce the same before the examiner of this court to the end that the plaintiff may examine the Witnesses upon the same. His Lordship orders that said Knight and Harvey the tenants of the premises do bring their rents and arrears to this court; the plaintiff is at liberty to alter the Christian name of said Thomas and renew his commission and both sides are to examine their Witnesses so that publication may pass by the middle of next term and in the mean time the defendant Mildred is to bring in all the deeds and writings confessed by her husband's answer to the examiner and leave the same, to the end that the plaintiff may examine Witnesses upon the same There is brought into this court £7 and no more, according to this order, this being 23 January 1661/2 Joseph Herner
