Deposition of Francis Bingham the Keeper of a Licensed Beer House at Potton Bedfordshire, on Oath says, I keep a Licensed Beer House at Potton in the County of Bedford, and makers of Pewter Pots, duly stamped according to Law, for the sale of Beer, and with my name engraved on them. One of the said Pots being a half pint Pot stamped and engraved as aforesaid the same now produced was missed from my house by my Mother Elizabeth Bingham who acts as my House Keeper on Friday evening last the 21st August inst whilst I was from home, and she told me of it as soon as I came home that night, and I said that she missed it as soon as Thomas Newman has left the house. He was in company of several others. In consequence of this information I went immediately to try [of others] I could find Thomas Newman and his companions at several other Beer shops but I did not succeed. Soon afterwards German Wagstaff who keeps an old accustomed Victualling House called the Fox and Crown at Potton came to my house, and showed me the Pewter Pot now produced, and asked me if it was mine, stating that he had found it on the person of the prisoner Thomas Newman. This Pot now produced is my property and is the same which was missed from my house on Friday night last. Deposition of German Wagstaff being present saith on Oath that the Evidence of Francis Bingham as far as he is concerned is true and correct. That on Friday evening last the 21st August inst the prisoner Thomas Newman came to his house the Fox and Crown at Potton in company with several others. Witnessed something in the heart of his waistcoat, I thought from the appearance it was a Pot. [He] accordingly unbuttoned Newman’s waistcoat and found the Pot now produced which is claimed by Francis Bingham as his property. Prisoner attributes the act to being so drunk that he was not aware of what he did. Francis Bingham is £40 to present to prosecute and give evidence. German Wagstaff is £20 to give evidence. Elizabeth Bingham on Oath saith I am the Mother of the Prosecutor Francis Bingham and I keep house for him. Inn keeper [or] licensed beer house at Potton. On Friday evening the 21st August last, four men came to our house and ordered some beer, They went away without paying for it and I followed them and touched one of them and said “Sir, you have not paid for your beer” He turned away from me, and denied having had any beer, and I thought from the manner of them, it was of no use to say anymore, so I went back to the house to see if the Pewter Pots were all safe, and I immediately missed one of them, there were no other customer in the house at the time, nor was any other person, besides the four men already mentioned, in the room where they had their beer I sent for my son, and told him what had happened, and he went in search of the four men. Bound in £20 to give evidence.
