John Hawes, James Oldfield -- Haw Hills and Miles Grove with pightle adjoining containing 40 acres -- New Pasture 35 acres -- the Fourteen Acres, the Dairy House Pightle and the Backside Meadow, containing 40 acres all in Houghton Conquest and parcel of the manor of Conquest Bury in occupation of said Richard Conquest -- cottages in Houghton Conquest in occupation of __ Field, widow William Rouse, Robert Freeman, William Holdstake, Philip Brand, ___ Butlard widow, Richard Allen, Robert Webb, Thomas Hawkins, William Fox, Edward Ward, Thomas Harris, John Cocher, Edmund Blade, John Wood, ___ Woodward, wife and Nicholas Green -- capital messuage lately erected in Chappell End near the Green there late in occupation of Lewis Conquest and then in occupation of Richard Conquest -- close 5 acres adjoining said messuage -messuage in Houghton Conquest once in occupation of Thomas Yarrell, then in occupation of said Richard Conquest -- 2 pightles of pasture containing 7 roods purchased of Thomas Day senior and Thomas Day junior then in occupation of said Richard Conquest -- 40 acres in open fields of Houghton Conquest formerly conveyed to Lewis Conquest by Sir Richard Conquest deceased in occupation of said Richard Conquest -- messuage and pightle adjoining, 1 acre in Chappell End once in occupation of Thomas Willcocks, then in occupation of said Richard Conquest -- Grange called Houghton Grange in occupation of said Richard Conquest -- Highfield, reputed to be parcel of said Grange, adjoining pightle then in occupation of said Richard Conquest -- Bushy Pightle called the Gosse Close adjoining to the Highfield, reputed to be parcel of Houghton Grange timber reserved to i. to hold to ii. for 2,000 years, peppercorn rent deed enrolled and recovery suffered, remainder to John Thimelby and heirs Recites: Indenture 30 September 1659 [see RO5/280] Whereas: said rent of £300 ran in arrears and further default of payment of £150 of aforesaid rent was made particularly at Lady Day 1673; said Maurice Thompson entered premises mentioned in last recited indenture and also into lands as aforesaid mortgaged to John Stone. Recites: writing of same date as presents made on back of last recited indenture, by which John Thimelby Conquest surrenders to Sir John Thompson term and estate for years granted by Maurice Thompson to said Richard Conquest Whereas: John Thimelby of Irnham, Lincolnshire esquire, son and heir of said Sir John Thimelby is seised of reversion of premises granted to Maurice Thompson by Indenture 28 September 1659 expectant on determination of last mentioned term of 2,000 years in trust for John Thimelby Conquest Whereas: suits have been presented between Richard Conquest in his lifetime and Maurice Thompson in his lifetime and between i) and ii) at common law in High Court of Chancery about account of profits of said premises and about clause in Indenture of 28 September 1659 "of all other messuages" etc. because said Richard Conquest in his life and John Thimelby Conquest since his death, claim that the manor and certain other lands were not intended to be included in that clause. Accounts have been given to said Court and have been debated before one of the masters of said Court who reported that there remained due to ii) £13,593..8s which has not been paid Whereas: premises of which Maurice Thompson and Sir John Thompson have had possession are admitted by i) to be scarce worth the money due on them To end all suits the following agreement is made: 1 i) will ratify to ii) premises mentioned in 2 schedules annexed, except all such premises as, not being in the occupation of said Sir John Thompson would not have passed by Indentuure of 28 September 1659 and except timber, to ii) for the remainder of two terms of 2,000 years limited by Indentures of 13 December 1652 and 28 September 1659. John Thimelby Conquest will assign to ii) term of years made by Indenture 14 December 1652, also that made by Indenture 30 September 1659; the two said Indentures and their counterparts to be cancelled 2 ii) will assign to John Thimelby Conquest lands mentioned in schedule annexed which are agreed to be surrendered by ii) to John Thimeby Conquest; similarly at cost of John Thimelby Conquest will convey all right in the advowson of the church of Houghton Conquest to Right Honourable Earl of Ailsbury and Thomas Dockery of Putteridge, Hertfordshire esquire (and will also deliver to them a bond by Thomas Pointer clerk, the present incumbent of said church to the said Maurice Thompson for the resignation of the said benefice). ii) agrees to the vacating, at cost of John Thimelby Conquest, of Recognizance entered into by i) and John Hall to the Master of the Rolls in penalty of £1,000 conditioned for performance of decrees made in said court; John Thimelby Conquest to have liberty of access for 8 years for felling timber 1 Jan 1695/6 Copy examined with the original in keeping of Thomas Armstrong of Ampthill, by William Pedder. 13 Jan 1737 1st Schedule.
