- Scope and ContentWill: -to eldest son William £20 within one month after testator’s death and £80 to be paid within 4 years 1 month; if William died before receiving legacies, to be divided amongst testator’s other children -£700 to wife Sarah in satisfaction of dower -£700 each to children Charles, Henry, Jane and Sarah at 21 -wife to have interest on said 4 childrens’ portions until their majority to pay for education and maintenance -wife executrix and gives her all estates he has on mortgage to enable her to pay debts -Peter Walton of London, gentleman and Michael Arnald of Ampthill, gentleman, overseers; 2 guineas each -residue to be divided between wife and 4 younger children dated 10 Nov 1702 [proved: Prerogative Court of Canterbury 12 June 1706 see RO1/81] Legal Opinion: the devise of the estate, mortgages etc. to executrix was to enable her to perform the things appointed and was not intended that she should have any interest in them to any other purpose; whatever the estate comes to more than is sufficient to pay debts ought to be shared between the wife and 4 younger children and that she ought not to have it all.
