    Robert Wade Grey: early on the morning of 24 July part of sheet of paling consisting of 2 oak rails and 10 pales were stolen from the rick yard. John Austin: about 2am on the morning of 24 July he was in a field and saw a man carrying something on his arm. He went after him and saw him throw it down and run into the wheat. After he got to the man, the man lay down and he could not tell who the man was. He asked the man his name and the man did not speak. 2 or 3 other men were about 100 yards off and on hearing him came and lifted the man up and found him to be Thomas Day. He went back to where Day had thrown something down and found a sheet of paling. Day also had a tin can in his hand. He inquired what Day had in it and Day replied nothing. On checking he found there to be milk. He took Day to the public house and sent for the constable. When asked Day said he had done it for poverty.
